1. Service Overview

Bookflexi.com is a hotel bidding platform designed to facilitate last-minute hotel bookings. Our platform connects guests with hoteliers, enabling guests to bid for hotel accommodations.

2. Confirmed Bookings

2.1. Once a booking is confirmed through the Bookflexi platform, it is binding and should not be canceled by the hoteliers.

2.2. In exceptional circumstances where a cancellation is unavoidable, the hotelier must provide a valid reason and may be subject to penalties or fees as determined by Bookflexi.

3. Use of the Platform by Hoteliers

3.1. Hoteliers agree not to misuse the Bookflexi platform. This includes, but is not limited to, contacting guests directly to convert bookings outside of the Bookflexi platform while an active bidding process is in progress.

3.2. Any attempt by hoteliers to circumvent the bidding process may result in suspension or termination of their account and may also incur additional penalties.

4. User Conduct

4.1. All users of Bookflexi.com agree to conduct themselves in a professional and ethical manner.

4.2. Users shall not engage in any activity that could harm the reputation or functionality of the Bookflexi platform.

5. Liability

5.1. Bookflexi.com shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of its services.

6. Indemnification

Users agree to indemnify and hold harmless Bookflexi and its employees, from any claim or demand made by any third party due to or arising out of your use of the service.

7. Modification of Terms

Bookflexi reserves the right to modify these terms and conditions at any time. Users will be notified of any changes through the website or via email.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Jurisdiction, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Jurisdiction for the resolution of any disputes.

For US contracts, the validity, construction and performance of this Agreement shall be governed and construed in accordance with the laws of the State of Delaware applicable to contracts made and to be wholly performed within such state, without giving effect to any conflict of laws provisions thereof.  The Federal and state courts located in the State of Delaware shall have sole and exclusive jurisdiction over any disputes arising under, or in any way connected with or related to, the terms of this Agreement and the Customer: (i) consents to personal jurisdiction therein; and (ii) waives the right to raise forum non convenient or any similar objection. ‍

For India contracts, the validity, construction and performance of this Agreement shall be governed and construed in accordance with the laws of the State of Karnataka applicable to contracts made and to be wholly performed within such state, without giving effect to any conflict of laws provisions thereof.  The state courts located in the State of Karnataka shall have sole and exclusive jurisdiction over any disputes arising under, or in any way connected with or related to, the terms of this Agreement and the Customer: (i) consents to personal jurisdiction therein; and (ii) waives the right to raise forum non convenient or any similar objection.
